The judge hearing the case against Bertuzzi in Colorado agreed with lawyers for Bertuzzi and threw out the case. The judge stated she has no standing to hear the case and that the case should be heard in Canada.
The judge is 100% correct in this case. The incident happened in Vancouver and should be heard in a Vancouver courtroom. If i committed a crime in another country my case would be held in that country not in Canada, so he is right.
The case got this far due to the differences between Canadian and American courts. American courts have shown that they give bigger settlements (read award more money) than their Canadian counterparts in cases involving personal injury. It was a nice try by Moore and his lawyers to try to have the case heard in Colorado, but as you said it amounted to a waste of time.
I suspect they will be filing in Vancouver court shortly.
I don't think Steve Moore will get very far. Considering the Crown do not press charges on Bertuzzi, it is unlikely that a civil trial will produce a favorable outcome. At least in canadian courts.
He should just drop the case and move on. He forgets that he took a run at M. Naslund the previous time they meet with the intent to take out his knee. Also he suffered the injuries as a result of the pile on of players (not only Bertuzzi's fault).
